NiteFlirt Privacy Policy for USERS, MEMBERS & FLIRTS

1. Introduction

This Privacy Policy describes how NF Entertainment, LLC, a Delaware limited liability company d.b.a NiteFlirt ("we," "us," "our" or "NiteFlirt") collects, uses, discloses, and protects the personal information of consumers ("you" or "your") and Flirts in accordance with our policies and applicable U.S. state privacy laws, including but not limited to the laws of California, Colorado, Connecticut, Florida, Montana, Oregon, Texas, Utah, and Virginia (collectively, the "U.S. State Privacy Laws") and European Union General Data Protection Regulation ("GDPR"). Although we do our best to protect the privacy rights of our Flirts, some of these laws do not apply to Flirts as they are not "consumers" as defined by these statutes. All capitalized terms not expressly defined herein have the meanings set forth in our Terms of Service.

We do not knowingly collect personal information from individuals under 18 years of age.

Your privacy and the security of your information is extremely important to us at NiteFlirt. This Privacy Policy describes the information we collect about you and what may happen to that information.

This Privacy Policy, together with our Terms of Service., Complaints Policy, Content Removal Policy, NiteFlirt Rules and Affiliate Agreement, collectively make up the "NiteFlirt User Agreement" that governs all users', Members' and Flirts' access to and use of our platform and Flirt Services, and is incorporated by reference therein. This Privacy Policy covers information you may provide directly or inadvertently to us through the NiteFlirt.com website, Mail, phone services, Goodies, Chat, Feeds (hereinafter collectively the "Site"). We reserve the right to change all or part of this Privacy Policy at any time with or without prior notice to you. The updated version will be indicated by an updated "Revised" date and will be effective as soon as it is accessible.

2. Personal Information We Collect

Unless your State-specific laws conflict, we may collect the following categories of personal information (together with Device Information (defined below), “Information”) as listed in the California Customer Records statute:

  • (a) Identifiers (e.g., real name, Member name, postal address, email address, phone number, IP address, and other personal identifiers);
  • (b) Protected classification characteristics under California or federal law, if provided (e.g. race, religion, sexual orientation etc.);
  • (c) Commercial information (e.g. products or services purchased or considered);
  • (d) Biometric Information: personal info that uniquely identifies an individual based on physical, physiological, or behavioral traits, such as facial features from a webcam, voice patterns from a microphone, or even keystroke patterns;
  • (e) Internet or other electronic network activity information (e.g. browsing history, search history, and interactions with our website);
  • (f) Geolocation data about your precise geographic location;
  • (g) Sensory data which includes audio, electronic, visual or similar information;
  • (h) Professional or employment-related information (if provided);
  • (i) Non-public education information (if provided);
  • (m) Inferences drawn from personal information (e.g. your preferences, behavior, etc.).

In addition, we collect device information from the devices you use to access the Site. Such information could include your device type, IP address, browser information, and other geolocation data (“Device Information”). NiteFlirt uses your Device Information to help identify you, diagnose problems with our server and to administer the Site. Generally, Device Information tells us the location from which a person is connecting to us, what service provider the person is using and which parts of the Site the user is visiting. We reserve the right to track Device Information for the purposes of fraud prevention, and we reserve the right to release Device Information addresses to legal authorities, if so compelled or as we see fit at our sole discretion.

If you register as a Member or purchase Flirt Services, we may also collect credit card information when you perform a transaction within your Member account, add money to your Member account, or use your credit card to take advantage of special promotions. NightFlirt uses a third-party to process credit cards for billing purposes, and Secure Socket Layer (“SSL”) digital encryption. This third-party may store or retain a Member's personally identifiable information. In certain cases, we will also use credit card information to help us verify your identity. We do not charge or bill the credit card when we collect credit card information for identity verification purposes.

3. How We Use Your Personal Information

Our primary goal in collecting Information from you is to provide you with a smooth and efficient experience while you and our Flirts are using the Site and to keep you informed of opportunities and options available from us. This allows us to provide services and features that are designed to meet your and our Flirts’ needs, and to customize our service to make your experience better, easier and quicker. We never sell, rent, or lease your Information to anyone. We will only share your information with third-party partners, for the reasons described below, to help us enhance your experience using the Site and Flirt Services. Your Information is only shared with third parties we do business with to provide better service to you, or to authorities as required by law. We do not share our Flirts’ Information with anyone other than as-needed in the manner described below.

Generally, we use your Information for the following functionality purposes:

  • (a) Providing or improving our products and services;
  • (b) Processing transactions and sending related communications;
  • (c) Maintaining and servicing Member and Flirt accounts;
  • (d) Providing customer service and support;
  • (e) Marketing and advertising;
  • (f) Analytics and improvement of our services or adding products and services;
  • (g) Security and fraud prevention;
  • (h) Legal compliance;
  • (i) Protecting the rights, property or safety of us, our users, Members, Flirts, and any related third parties.

We use the Information we maintain about you, and other information we obtain from your current and past activities on the Site, to resolve disputes, identify potential liabilities, troubleshoot problems and enforce our Terms of Service. At times, we may look at your Member account or Flirt account information and transaction history to identify problems or resolve disputes. We also use the Information we collect to detect and prevent fraudulent activity, as required or flagged by law. We share suspicious activity and related Information and/or Content with third-party service providers as is necessary for the functionality of our Site, as well as to law enforcement in order to assist with this effort.

In addition to the general uses set forth above, our specific uses of Information are set forth below:

Age Verification: Age verification is critically important to us. As an online platform providing third-party adult content, entry to the Site requires age verification by law. NiteFlirt requires Flirts, Members and users to be at least eighteen (18) years of age, or the age of majority in your jurisdiction if older than 18, to use any area of the Site or Flirt Services, and requires all Members, Flirts and users to agree to the NiteFlirt User Agreement in its entirety. Minors under the age of eighteen (18) are not eligible to use our Site. If you become aware that a minor under the age of 18 has created a Member or Flirt account, is accessing the Site and/or has provided NiteFlirt with personal information for any purpose, please immediately let us know at playfair@niteflirt.com or by submitting a Customer Support Form (select “Playfair Inquiry”).

Member/Flirt Name: When you register for an account on our Site, either through our online registration form or over the phone, we may collect your Information, including without limitation your email address, Member name, real name, password, phone number and other personal information listed in the registration form. Your individual Member or Flirt name is used throughout our Site and to identify you to other Members, users and Flirts. Therefore, you should be aware that if you use your real name, or other name or handle that uniquely identifies your real name, as your Member or Flirt name, this information will be visible to others who visit the Site. We strongly discourage the use of your real name as a Member or Flirt name on the Site.

Password: All Members’ (including Flirts’) passwords are encrypted and only used to provide you with access to your individual account on our Site. We strongly suggest that all Members and Flirts use a password unique to this Site, which shall never be shared with any other person or entity.

Telephone Number: Because we connect Members and Flirts by telephone, if you purchase, provide or utilize Flirt Services, we require you to enter a valid telephone number to connect with Members or Flirts, as the case may be. At no time will we share a Flirt’s telephone number with a Member, or Member’s telephone number with a Flirt. Because NiteFlirt initiates all telephone calls, Members and Flirts are unable to see each other’s real telephone numbers, not even with caller ID. Note that, although our systems maintain the connection between the parties to a Flirt Service telephone call, we do not monitor or record the content of any calls. However, we reserve the right at all times to monitor, interrupt or intercede any call for liability, legal compliance, safety, fraud, endangerment or any other purpose, at our sole discretion and/or if mandated by law.

Email Address: As a Member, we may use the email address you provide us to contact you regarding account activities, new product offerings and communications relevant to your use of the Site and/or Flirt Services. If you do not wish to receive such communications from us, you have the ability to opt-out of these email communications by filling out a Customer Support Form, or upon registration, by unchecking the box which asks if you wish to receive such mailings. You will, however, continue to receive administrative and transaction-related emails from us that are related to billing, customer service, usage and overall functionality of the Site (collectively “Administrative Emails”). You may not opt-out of these Administrative Emails unless you cancel your Member account. You may cancel your Member account HERE.

Identification: We may collect certain Information to verify our users, Members’ and Flirts’ identity. In order to verify this identity, we use a third-party service that will collect a government issued ID, such as driver’s license, passport, and where required, biometric information in the form of facial analysis from webcam or other sources, physical, physiological, or behavioral characteristics, voice patterns from a microphone, or even keystroke patterns, and liveness check. This third party may use, store or retain the information and visual media provided in accordance with their privacy policy. We advise our third-party service providers that they are subject to California’s Privacy Right Act (CPRA) and are not permitted to share this information with any other person or entity as and unless required by law.

Mail and Chat: We facilitate communication between Flirts and Members through our on-site Mail, Chat and phone systems. Messages sent via Mail and Chat are identified only by your Member or Flirt account name. We strongly recommend you maintain strict confidentiality as to your real identity. Members and Flirts should not provide any personally identifiable information within these Mail and Chat interactions. We are not responsible for any disclosure of personal information or any resulting harm that disclosing same may cause.

Other Profile/Site/Feed Information: Members and Flirts may provide additional profile information (such as experience, affiliations, schedule, and for Flirts, visual images and/or Content etc.) that is displayed on your profile and/or (for Flirts) published on our Feed/the Site. While we do not sell or rent such information to any third party, note that we are not responsible for maintaining the privacy of information posted publicly to the Site. If a Member or Flirt chooses to post on any NiteFlirt Feed or forum, please know that any personally identifiable information that you post can be read, collected, or used by others, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information that you provide publicly, whether knowingly or unknowingly, through these Feeds and/or forums, nor any resulting damage you, or any other user, Member, Flirt or third party may suffer as a result.

Information Specific to Flirts: If you are a Flirt providing Flirt Services through the Site, we collect additional information from you so we can verify your identity and process and remit to you the funds you earn. We collect your mailing address and your bank account information in order to remit payments. We collect your Federal Tax ID (Social Security number or Employer Identification Number) to prepare Form 1099-K, if necessary, and to help us verify your identity and to ensure we abide by all financial and taxation-related laws. Flirts who are not United States citizens, residents or taxpayers will not be asked for their Federal Tax ID, though they may need to report income to their specific jurisdiction’s tax authority and will be required to provide us with equivalent evidence of their age and identity. We do not provide tax advice to Flirts or any other individual or entity. All Flirts are advised to consult with their own tax advisors to ensure proper compliance with their jurisdiction’s applicable laws.

Content Moderation: If any Member or Flirt uploads any Information or Content to any portion of our Site or Feed, or through the provision of Flirt Services, such Content or footage will be reviewed by a third-party content moderation service that utilizes artificial intelligence (“AI”) to moderate said Content, in addition to human moderation, and ensure it is in compliance with the NiteFlirt User Agreement and all applicable laws. Links to Outside Websites: Our Site may contain links to third-party websites. When your browser leaves our Site, NiteFlirt is not responsible for the privacy practices or the content of third-party pages or websites. We encourage all users, Members and Flirts to carefully review the terms of service and privacy policies of all third-party websites, links and accounts into which they wish to browse or enter. We are not responsible for any undesired or unrequested disclosures of Information by any third-party page or website, whether or not linked to by us, whether directly or indirectly.

Analytics: We may use certain Information collected from our Flirts and/or Members in aggregate form, directly or through third-party providers (such as Google Analytics), to tailor our Flirts’ and Members' experience on the Site, for instance, by showing certain Members Content that we think they might be interested in, and/or suggesting/displaying specific Flirts and/or Content according to Member preferences and behavior.

Google Analytics: We use a tool called ‘Google Analytics’ to collect information about the use of the Site. Google Analytics collects information such as how often users visit the Site, what pages they visit, and what other sites they used prior to coming to our Site. Visit Google’s website identifying exactly what Google Analytics collects. NiteFlirt uses the information collected from Google Analytics only to improve Members’ experience with the Site. Google Analytics collects only the IP address assigned to you on the date you visit NiteFlirt, rather than your name or other identifying information. Unless required by court order or law enforcement, we do not combine the information collected through the use of Google Analytics with personally identifiable Information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit the Site, the cookie cannot be used by anyone other than Google. Google’s ability to use and share information collected by Google Analytics about your visits to our Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy.

Cookies: Our Site utilizes cookies. Cookies are small amounts of data sent to a user’s (including Members’ and Flirts’) browser from the NiteFlirt web servers and stored on a user, Member and/or Flirt’s computer’s hard drive. NiteFlirt uses cookies to track the pages on the Site that our users, Members and Flirts visit. This allows us to collect aggregate information about usage on the Site. NiteFlirt may also use cookies to deliver content specific to Members' interests, and to keep track of Members’ names, passwords and preferences so that Members do not have to re-enter them during a session. Sessions are tracked to improve users’/Members’/Flirts’ on-site experience and for us to refine our own marketing programs. You can manage your cookie settings directly on your browser, or when applicable, on your device. If you choose not to accept cookies, you may be unable to use all or part of the Site.

Complaints: If users, Members or Flirts send NiteFlirt email correspondence or otherwise correspond through the Complaint Policy or Customer Support Form available on the Site, or if any third party sends us email or other correspondence regarding a particular Flirt or Member's activities or postings in connection with the Site, NiteFlirt may collect, use, store and or otherwise utilize such complainant’s Information to the extent allowed and/or in accordance with applicable law.

4. Disclosure of Personal Information

Except as explicitly stated herein, we do not sell, rent or trade any personally identifiable Information to any third party. Your Information is not sold, rented, or leased to any third party for marketing, sales, advertising or any other purposes.

As discussed further below, in very specific circumstances we may disclose your Information to:

  • (a) Service providers and contractors that perform services on our behalf;
  • (b) Business partners as part of joint marketing efforts (if you haven’t opted out);
  • (c) Affiliated companies;
  • (d) Related parties on an as-needed basis in connection with the sale or transfer of our business or assets;
  • (e) Government authorities or other third parties as required by law or for regulatory purposes.

We may disclose your personal Information to appropriate authorities and/or to banks and other financial and payment processing institutions associated with your Member or Flirt account in order to process transactions, issue credits, and/or to prevent or report suspected fraud and/or illegal activities, in order to prevent harm, fraud, endangerment to any persons, and/or if we believe in good faith that disclosure is required by law. In some cases, the government can compel the disclosure of information about you, and we will comply, and by accessing and utilizing our Site you authorize us to do so. You also consent to us disclosing Information about you in connection with disputes involving payment, membership, Content, other Flirts or Members, and to actual or potential parties to a lawsuit or action that we are or may become involved in, (a) if we are required to do so, (b) if we reasonably believe that such disclosure will potentially mitigate our liability, and/or (c) to enforce our rights.

As stated above, NiteFlirt may disclose some personally identifiable Information to vendors and third-party service providers in connection with communications and payments to Flirts, Members and other aspects of operating and promoting the Site and Flirt Services. For example, we use a third-party company to deliver NiteFlirt promotions, and we share your email address with these companies unless you opt-out of receiving NiteFlirt's promotions by unchecking the box on the Personal Info Page which asks if you wish to receive such mailings.

5. NiteFlirt SMS Messaging Program

NiteFlirt only uses informational SMS messaging programs (called SMS Alerts) to inform a Member that they have a new Chat message, and only after they have Opted-In to the use of SMS messaging. SMS Alerts are off by default for all Members. See below for more information.

SMS messaging is NOT used: (a) for communication between a Flirt and Member, (b) for communication between Member and other Members, (c) for marketing or promotional purposes; (d) other than for technical purposes, to share a Member or Flirt's phone number with any third parties, or our affiliates, or (e) for the sale, rental, or trade of a Member or Flirt's phone number with third parties.

Information We Collect for SMS Messaging Program. In connection with the NiteFlirt SMS messaging program, we may collect:

  • (a) your mobile phone number, provided during account registration and verified through our phone verification process before SMS programs can be enabled;
  • (b) opt-in records, including the timestamp, IP address, and account identifier captured when you enable an SMS program;
  • (c) message metadata, including timestamps, delivery receipts, error codes, message origination and/or destination points, IP addresses, device and/or carrier information, and other technical information related to the transmission of SMS messages;
  • (d) opt-out records, including the timestamp and method (STOP keyword reply or settings toggle) when you opt out;
  • (e) Session Initiation Protocol (SIP) header anomalies;
  • (f) Evidence that the message was an Unwanted Message (e.g. evidence that the message was abusive, harmful, malicious, unlawful, SHAFT content, or otherwise inappropriate);
  • (g) information related to the volume of messages; and
  • (h) any communications you have with NiteFlirt support related to SMS programs.

We do not collect the content of replies beyond recognized command keywords (STOP, HELP, START).

How We Use SMS Information. We use the Information described above to:

  • deliver SMS notifications you have opted in to receive;
  • verify your identity and account ownership;
  • maintain records of opt-in and opt-out consent as required by applicable law and carrier requirements;
  • diagnose and resolve delivery problems;
  • detect and prevent fraud and misuse of NiteFlirt SMS programs;
  • comply with legal and regulatory obligations, including the Telephone Consumer Protection Act (TCPA) and CTIA (the wireless industry association) guidelines; and
  • respond to your support requests.

Who Has Access. SMS-related Information is accessible to:

  • (i) NF Entertainment, LLC employees and contractors who require access to operate and support NiteFlirt SMS programs; and
  • (j) our SMS delivery service provider, which delivers SMS messages on our behalf and receives the phone number, message content, and delivery metadata necessary to perform this function.

We require all third parties with access to SMS data to maintain appropriate confidentiality and security protections and to use SMS data only for the purposes for which it was provided.

Data Retention. We retain opt-in records for the duration of your account plus a reasonable period following opt-out as required to demonstrate consent under applicable law. Message delivery metadata is retained for accounting, operational and compliance purposes. Phone numbers are retained as part of your NiteFlirt account record in accordance with the general retention practices described in this Privacy Policy.

Volume of SMS Messages. NiteFlirt will only send SMS messages when a Member has SMS Alerts enabled, receives a Chat message and has been inactive for 30 minutes or more. NiteFlirt is not responsible for the volume of messages sent by a Member or Members in the aggregate. Members are able to set Quiet Hours for SMS Alerts and are able to opt-out of receiving SMS messages at any time and in their sole discretion.

Your SMS Rights. You may opt out of any NiteFlirt SMS program at any time as described in Section 12 of our Terms of Service. You may also access, request correction of, or request deletion of your SMS-related Information, subject to our obligation to retain proof-of-consent records, by contacting us as described in the general "Your Privacy Rights" section of this Privacy Policy.

6. Your Privacy Rights

Depending on your U.S. state of residence, you may have the following rights in connection with the Information we collect, use and/or disclose:

  • (a) Right to know/access;
  • (b) Right to delete;
  • (c) Right to correct;
  • (d) Right to opt-out of sale or sharing of personal information;
  • (e) Right to limit use and disclosure of sensitive personal information;
  • (f) Right to data portability;
  • (g) Right to non-discrimination for exercising your privacy rights.

Although California State law applies to the interpretation of the NiteFlirt User Agreement, your individual state privacy rights apply to you. California privacy rights do not apply to you unless you are residing in the State of California. Note that the specific laws of your state of residence will control to the extent they conflict with the general terms stated elsewhere in this Privacy Policy. These state-specific rights are in addition to any general rights afforded to you, described below, subject to approval of the individual state. If your state is not listed, the general terms stated below and elsewhere in this Privacy Policy apply to you.

If you are accessing our Site or using Flirt Services from outside the US, including in the European Economic Area, please be aware that your Information will be transferred to the US, stored on US servers, and potentially processed in other countries whose data protection laws may not be as protective as those in the EU. All collection, storage, use, disclosure and security of your Information will be in accordance with this Privacy Policy.

Accessing, Updating, and Correcting your Information: You can review, update and change some of your personally identifiable Information — including your email address, telephone number, password and PIN number — by clicking on the Account Info link on the Account page. You can view and update your credit card information and billing address on the Manage Credit Cards page. To update your payee address and information, visit the Payment Info page. You may correct, update or delete any of your NiteFlirt listings by clicking on the Listings link on the Account page. You may also request a copy of the personal Information we maintain about you or your account by filling out a Customer Support Form.

We only keep your personal identifiable Information for as long as necessary to fulfill the purposes described in this Privacy Policy, as determined by us at our sole discretion, or as required by law, including without limitation, certain U.S. State privacy laws, and the EU's General Data Protection Regulation (GDPR). Consumers located in certain US states and EU have the right to request their data be deleted and can do so by filling out a Customer Support Form. In some cases, we must retain some Information for a limited amount of time after you have requested your information be deleted, as required by law or as reasonably necessary for business purposes.

Deletion of Your Data: The best way to delete your Information is to cancel your Member account on our Site. If you decide you would like to cancel your Member account, you can do so by either of the following: (a) sending us an email to privacy@niteflirt.com (include your Member name and email address); or (b) filling out a Customer Support Form asking us to cancel your account; or (c) clicking HERE. Note that we may retain a portion of your Information for reasonable business purposes (e.g. payment processing, customer relations, security, fraud prevention, preserving or defending our legal rights) and/or as required by law.

Notification of Financial Incentive: We do not sell, lease or rent your Information to third parties. If we at any time offer any financial incentive in exchange for the collection, retention, or sale of personal Information in the future, we will provide a clear description of the material terms of the incentive program.

Exercising Your Privacy Rights: To exercise any other privacy rights, you may:

We will verify your identity before processing your request. You may also designate an authorized agent to make a request on your behalf. While we will do our best to address your request within seven (7) business days, note that it may take up to 45 days to have your request fully resolved.

7. Security of Your Personal Information

NiteFlirt has implemented industry standard security measures in place to help protect against the loss, misuse, alteration, unauthorized access, improper disclosure and unlawful destruction of the Information under our control. We protect Information by maintaining physical, electronic and procedural safeguards in compliance with applicable US federal and state regulations. We use Secure Socket Layer (SSL), which digitally encrypts your information as it is transferred from your computer to NiteFlirt. We use computer safeguards such as firewalls and data encryption and we enforce physical access controls to our buildings and files. We also take the following measures to protect user Information once it is received by the Site:

  • Employees have limited and controlled access to Members’ and Flirts’ Information;
  • Measures have been taken so that servers and the data stored thereon are in a secure physical location;
  • Security software is used where NiteFlirt determines it to be both appropriate and cost effective;
  • Employees are informed of all security protocol on a regular basis, and
  • Web security procedures are quality-assured weekly.

Although we strive to keep your and our Flirts’ personal Information secure, no security measures are absolute and fool-proof and there is always a possibility that a security breach could occur, resulting in the release of your data or Information. Users, Members and Flirts should consider all Information, communications, and data provided to our Site to be non-confidential, and consequently, we assume no responsibility or liability if any Information relating to any user, Member or Flirt is intercepted and/or used by an unintended recipient. We will notify you of any data breach as required under applicable law.

8. Notification of Changes

We will do our best to notify you by email and/or a notice in your Member/Flirt account if there is a material change in our privacy practices or policies. We will take commercially reasonable measures to obtain written or active email consent from you if we will use the Information collected from you in a manner different from that stated at the time of collection. We will also do our best to notify you by email and/or a notice in your Member/Flirt account of the changes in this Privacy Policy thirty (30) days prior to a change, and at that time you will be given the opportunity to accept the changes or otherwise cancel your Member/Flirt account.

California Specific Provisions

Your rights under California law:

  • (a) Shine the Light Law: California residents may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
  • (b) Do Not Track: We currently do not respond to "Do Not Track" signals from web browsers.
  • (c) Minors: We do not knowingly collect or sell personal information of minors under 16 without affirmative authorization.
  • (d) Right to Know: You may request information about the personal information we have collected about you in the past 12 months, including the categories of information collected, the sources, the business purpose, and the categories of third parties with whom we share the information.
  • (e) Right to Delete: You may request deletion of personal information we have collected from you, subject to certain exceptions.
