This Adult Content Policy forms part of the Member Agreement and is incorporated by reference therein. Capitalized terms not defined herein will have the meanings set forth in the Member Agreement and related policies.
The Site includes language, content, images and themes of an adult, sexual or controversial nature (collectively, "Adult Content"). To ensure that Niteflirt listings do not inadvertently offend some Members or users and do not violate any relevant laws, Niteflirt exercises its judgment in the best interests of its entire membership by allowing, segregating or rejecting certain listings. Telephone communications, discussions, postings and other services that may not be appropriate for all users, such as listings that include language, content, images and themes of a sexual or controversial nature ("Sexually-Oriented Content," as described below), are restricted to Niteflirt's "Adults Only" Area. Listings that are illegal in any jurisdiction are prohibited on Niteflirt.

Does Niteflirt permit Speakers to post Sexually-Oriented Content listings?
Yes. To ensure that any Adult Content is not accessible to minors, entry to the Site requires age verification. Furthermore, to avoid inadvertently offending adult Members or users of Niteflirt, all Sexually-Oriented Content and conversations are restricted to the "Adults Only" area on Niteflirt.

You will take your time to carefully consider and find the appropriate category in which to create your listing. You will not send Mail or engage in conversations containing Sexually-Oriented Content except through the Adults Only section. If you create a listing within the Adults Only section of the Site, you will not create any listing outside of the Adults Only section. Likewise, if you create listings in any category outside of the Adults Only section of the Site, you will not create listings within the Adults Only section.

What are the requirements for entering Niteflirt's Site?
Niteflirt requires all Members and users who accesses or uses any area of the Niteflirt Site to be eighteen (18) years old or older and requires them to agree to the terms of the Age Verification Agreement. This extra precaution helps to ensure that minors do not have access to Adult Content material.

What kind of listings does Niteflirt consider to be Sexually-Oriented Content?
Material that Niteflirt, in its sole discretion, considers to be Sexually-Oriented Content includes, but is not limited to, the following content:

• Descriptive sexual language.
  
  
• Any reference in a listing to any form of sexual intercourse or behavior, actual or simulated.
  
  
• Any listing that contains sexually explicit or sexually related text or images (of partial or full nudity).
  
  
• Any listing whose purpose is to sexually arouse a Member or user or cause lascivious or lustful thoughts.
  
  
• Any listing which is intended to let Members or users know that the Speaker has listings that appear in the "Adults Only" section, other Adult Content websites or other Adult Content locations.
  
  
• Any listing which, because of the nature or because of the description in the listing, appears to be designed solely to solicit sexual/adult talk, such as: "I'll talk about anything", "Tell me your wildest dreams," etc.
  
  
• Any listing whose feedback consistently indicates that the Speaker is engaging in Sexually-Oriented Content conversations.
  
  
• Some listings may have sexual content, but are not considered Sexually-Oriented Content, such as discussions limited to sexual medical issues and/or sexual education.
  
  

Are there any limits on the types of Adult Content material that is permitted on the Niteflirt website?
Yes. Members are expected to follow all applicable federal, state and local laws, regulations and ordinances relating to obscene and indecent content and communications. In particular, obscenity and child pornography are prohibited on Niteflirt because they violate the laws of the United States and many other countries. While obscenity is not always easy to define and depends on the standards in your area, Niteflirt specifically prohibits any listings, Mail or conversations that contain content related to bestiality, rape sex, incest, sex with graphic violence or degradation, excretory functions, bodily fluids, fisting and any other content which may be judged as obscene. With respect to child pornography, Niteflirt will remove any listings and prohibits any Mail containing or referring to child pornography, such as listings containing the word "Lolita" or referring to nude photographs of "girls," "teens" or "children." In no event may images of children, whether nude, clothed or partially clothed, be posted in Mail or in any area of the Site, including Speaker listings. In the event that Niteflirt discovers child pornography or images of children in any listing, Mail or otherwise, Niteflirt will promptly notify the National Center for Missing and Exploited Children and/or the appropriate law enforcement agency.

In addition, pornographic images, including sexually graphic "wallpaper" as a backdrop to a listing, are not permitted in any Mail or in any area of the Site, as outlined in our Photo Policy and this Adult Content Policy. Notwithstanding the foregoing, Speakers may send Mail containing nude images, provided that any such Mail containing nude images has been initiated from and is restricted to the Adults Only section of the Site and complies with this Adult Content Policy. Nude images are not permitted in any Speaker listing or elsewhere on the Site, as outlined in our Photo Policy. In no event may images of children, as outlined above and in our Photo Policy, be posted in Mail or in any area of the Site, including Speaker listings.

What will Niteflirt do if it finds unrestricted listings that belong in the "Adults Only" area of the Site?
If Niteflirt finds a listing that it determines, in its sole discretion, belongs in the Adults Only area of the Site, Niteflirt will delete that listing and notify the Speaker via email of the change. If a Speaker repeatedly posts Sexually-Oriented Content in unrestricted areas of the Site, Niteflirt reserves the right to cancel, without notice, his or her membership.

What will Niteflirt do if it finds listings that contain Adult Content, or is notified that Mail contains Adult Content, that is prohibited on the Niteflirt Site?
Niteflirt reserves the right to suspend at any time and without notice any listing, and to cancel at any time without notice the membership of any Member, that Niteflirt, in its sole discretion, determines to be in violation of its Adult Content Policy. Niteflirt will take all appropriate steps with listings that Niteflirt believes violate applicable laws, including cooperation with any investigation.

What should Niteflirt Members do if they see listings that should be restricted to the Adults Only area of the Site or are prohibited from the Site?
If you see a listing that you believe should be restricted to the Adults Only area of the Site or is prohibited from the Site altogether, fill out a Support Form and selecting "Play Fair Inquiry" from the drop down menu. Niteflirt will review the listing and determine whether to move it to the Adults Only area, remove the listing from the Site and/or report the listing to the appropriate authorities. Niteflirt appreciates your assistance in keeping the Niteflirt Site free of material that is illegal or may be offensive to Members or users.

What are NiteFlirt's requirements regarding 18 USC 2257?
Members are solely responsible for the content of their listings and ensuring that they are in compliance with all applicable laws and regulations, including but not limited to providing certain record location information under 18 USC 2257 and corresponding regulations where applicable. NiteFlirt is not able to advise Members or Speakers on the legal requirements that may apply to their account and you are urged to consult with your our legal counsel.
